Realty Watchers — AI-Powered Property Management
These Terms of Service (“Terms”) govern your access to and use of the Realty Watchers platform, including the Leasify dashboard, AI-powered voice services, and related tools (collectively, the “Service”), operated by Realty Watchers (“Company,” “we,” “us,” or “our”).
By accessing or using the Service, you (“Customer,” “you,” or “your”) agree to be bound by these Terms. If you do not agree, do not use the Service.
3.1. You must be at least 18 years old and have the legal authority to enter into these Terms.
3.2. You agree to provide accurate, current, and complete registration information and to keep it updated.
3.3. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
3.4. You must notify us immediately of any unauthorized use of your account.

4.2. Features may vary by subscription plan and may be modified, added, or removed at our discretion with reasonable notice.
5.1. Access to the Service requires a paid subscription unless otherwise agreed in writing (e.g., beta or trial agreements).
5.2. Subscription fees are billed in advance on a monthly or annual basis as selected at signup.
5.3. All fees are non-refundable except as required by applicable law or as explicitly stated in a separate agreement.
5.4. We reserve the right to change pricing with 30 days’ written notice. Price changes will take effect at the start of the next billing cycle.
5.5. If payment fails, we may suspend access to the Service after providing 7 days’ notice and an opportunity to cure.
6.2. You grant us a limited, non-exclusive license to use, process, store, and transmit Customer Data solely to provide, maintain, and improve the Service.
6.3. Upon termination, you may request an export of your Customer Data for up to 30 days. After that period, we may delete Customer Data in accordance with our data retention policies.
6.4. We will not sell, share, or disclose Customer Data to third parties except:
7.1. The Service uses artificial intelligence and machine learning technologies, including third-party AI models, to power features such as the voice assistant, lead scoring, and automated communications.
7.3. AI-powered calls and communications may be recorded and transcribed for quality assurance and service improvement. You are responsible for complying with applicable call recording and consent laws in your jurisdiction.
7.4. You agree not to use AI features to generate content that is illegal, discriminatory, harassing, or in violation of fair housing laws.

9.1. You acknowledge that property management activities are subject to federal, state, and local fair housing laws.
9.3. We do not provide legal advice. If you have questions about your obligations, consult a qualified attorney.
10.1. We target 99.5% monthly uptime for the Platform but do not guarantee uninterrupted availability.
10.2. Scheduled maintenance will be communicated in advance when reasonably possible.
10.3. Support is provided via email and in-app channels during regular business hours (Monday–Friday, 9 AM–5 PM Central Time), unless otherwise specified in your subscription plan.
10.4. We are not liable for service interruptions caused by factors outside our reasonable control, including internet outages, third-party provider failures, or force majeure events.
11.1. Our collection, use, and protection of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
11.2. We implement commercially reasonable administrative, technical, and physical safeguards to protect Customer Data.
11.3. In the event of a data breach that affects Customer Data, we will notify affected Customers in accordance with applicable law.
12.1. The Service, including its software, design, documentation, and branding, is owned by Realty Watchers and protected by intellectual property laws.
12.2. These Terms grant you a limited, non-exclusive, non-transferable license to access and use the Service for your internal property management purposes during your subscription term.
12.3. Customer feedback, suggestions, or ideas submitted to us may be used without obligation or compensation to improve the Service.
13.1. The Service may integrate with or rely on third-party services (e.g., Twilio for voice/SMS, OpenAI for AI models, Stripe for payment processing, Google Calendar for scheduling).
13.2. Your use of third-party services is subject to their respective terms and policies. We are not responsible for third-party service performance, availability, or data practices.
14.1. To the maximum extent permitted by law, Realty Watchers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill.
14.2. Our total aggregate liability arising out of or related to these Terms shall not exceed the total fees paid by you in the twelve (12) months preceding the claim.
14.3. These limitations apply regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise).
15.1. The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
15.2. We do not warrant that the Service will be error-free, secure, or uninterrupted, or that AI-generated outputs will be accurate or complete.
You agree to indemnify, defend, and hold harmless Realty Watchers, its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:
17.1. These Terms are effective upon your first use of the Service and continue until terminated.
17.2. You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
17.3. We may suspend or terminate your access if you breach these Terms, fail to pay fees, or if continued service would be impractical or unlawful.
17.4. Upon termination, your right to use the Service ceases immediately. Sections 6.3, 12, 14, 15, 16, 18, and 19 survive termination.
18.1. Governing Law. These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.
18.2. Informal Resolution. Before filing any formal claim, you agree to contact us and attempt to resolve the dispute informally for at least 30 days.
18.3. Arbitration. Any dispute not resolved informally shall be settled by binding arbitration in Harris County, Texas, under the rules of the American Arbitration Association. Judgment on the award may be entered in any court of competent jurisdiction.
18.4. Class Action Waiver. You agree to resolve disputes on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.
19.1. Entire Agreement. These Terms, together with the Privacy Policy and any executed order forms or service agreements, constitute the entire agreement between you and Realty Watchers.
19.2. Amendments. We may update these Terms from time to time. Material changes will be communicated via email or in-app notice at least 15 days before taking effect.
19.3. Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
19.4. Waiver. Failure to enforce any provision does not constitute a waiver of that provision.
19.5. Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
